There are two types of encounters

In India, police conduct encounters in two ways. First, when a criminal tries to escape from the custody of police or security forces. In such a case, police conducts an encounter to catch him. The second way is when police goes to arrest a criminal. And in such a case, the criminal runs away to avoid arrest and attacks the police. In such a case, police conducts an encounter by taking retaliatory action to escape and catch him. 

You have to shoot yourself in the leg

There is no mention of encounter in the Constitution of India. But the police and security forces use this word when they encounter criminals and terrorists in any operation. If a criminal tries to escape from the custody of the police or security forces, the police first warns him. But the criminal still does not listen and tries to escape.

In such a situation, the police and security forces shoot at his leg so that he cannot run away. But if the situation goes out of control, then the target of the police can be any part of the body other than the leg and in such an encounter, the criminal also dies.  

What is the section of the law?

Under Section 40 of the Code of Criminal Procedure (CrPC), it has been ensured that if a criminal tries to escape to avoid arrest, or escapes from police custody, or attacks the police, then in such a situation, the police has the right to take retaliatory action.
